How to Notarized a Document by a Notary Public?

It is necessary to have an agreement, deed, affidavit, or any other item that you want to be a public record notarized.

The first step in having a document notarized is to determine whether it is required. If a notary public is necessary, you must find a registered and legitimate notary public. Another simple option to have a document notarized is to look for a notary near your business or home.

A notarized instrument or document is one that bears a dry seal with a stamp, indicating that the signature on the document is authentic. A Notary Public is obliged by law to witness your signature on the document before stamping it. This provides security and verification that it is you who signed the document.

In the era of identity theft the Notary Public is required to ask for Competent Evidence of Identity. Competent Evidence of Identity refers to the identification of an individual based on the following: (Examples: Drivers License, SSS ID, PRC ID, Passport and any government issued ID)

(1) At least one current identification document issued by an official agency bearing the photograph and signature of the
individual; or (2) The oath or affirmation of:

(a) One credible witness not privy to the instrument, document or transaction who is personally known to the notary public
and who personally knows the
individual,

(b) Two credible witnesses neither of whom is privy to the instrument, document or transaction who each personally knows the individual and shows to the notary public documentary identification.

In case the notary public is not assured that your identity, he or she can reject to notarize your document. Make sure that you bring your unsigned document to the notary public.

In addition to confirming your identity, a notary public is expected to make sure that the signing the document is voluntary or free from any coercion. As well, the notary public needs to be certain that you really understand the document that you are signing.

It depends on the document to be notarized, you may have to pay a modest fee. Notary public have to incur expenses to
maintain and run as a notary, they need to study and keep abreast with ever changing laws, and they have to secure the
records, therefore don’t be surprised if you’re asked to pay a fee.
